micofrost04-12 03:16 PMSome where I read that there is no fee for renewal of AP. I am a Jul 07 filer and am not sure about this. Further already applied last for Advance parole and travelled till it got expired last month. I am applying for a new one again. So just wanted to know if I need to pay the fees $305.
So my questions are:

Does the July 07 filers need to send the cheque for $305
Should we also include Biometric fee of $80?

And how much time is it taking these days for AP/

There is a confusion regarding who pays what amount.
To avoid the filing date confusion, stick to this simple rule :

If you paid less than $400 ( I do not remeber the exact I-485 fees prior to the increase), then you need to pay for the Ap and EAD, the respective amount. If you paid more than $900 for your I-485 filing, then go file AP and EAD as much as you want.
For either case, you do not have to pay for the biometric. Biometric is only for EAD. Not for AP.

AP takes roughly 45 days.

Student with no hopes04-15 11:48 AMGraduated from college last year, finally found a job that I really like. Currently on OPT. Just curious to know how long will it take for employer to apply for labor and I-140.

I know most of you are thinking - "are you mad, esp with current gc situation? " the thing is I like it here. My relatives and friends are here. I am hoping that with so many people stuck in the gc process, somebody has to fix it soon - and I (& other newcomers) will benefit from better immigration policy.

can any one let me know how long the initial stages take currently?

perm2gc11-10 10:52 AMI came to US on H4, 3 years ago. Later I took my H1B with a recruiter and got it with I-94. It was valid up to 2007 oct. But I couldn't take up any work due to some problems. Recently I went to India and came back. At the port of entry I got new I-94 with H4 stamping. Means My H1 Is not valid now ? In this case, is there any way to apply for change of status again as my H1 is valid up to 2007. Or else do I need to apply for my new H1B again ? Pl. any one clarify.
If you have changed status from H4-H1..how come you entered on H4 again..
As per my knowledge your H4 status ends once your H1B is approved and if you go out of country..you have to get your H1B stamped and enter the country...

I may be wrong ,please consult a good immigration attorney

GotGC??02-25 08:30 PMActually, you can file 485 when your PD becomes current, even if the 140 is still pending approval. You need to submit the 140 details alongwith your 484 application.

Once a I140 is filed without the I485 one has to wait for I140 approval before being eigible for filing I485

I check the nvars website everyday, but it always says no appointments available. I read some posts here about how hard it is to find appointments, and started checking in the afternoons during work like they mentioned. I search in montreal, toronto, and vancouver but I don't find anything. Don't even need one for next week - anytime is ok.

Also, I looked at some services like XVARS and NvarsAppointment - does any one have any experience using these services?

Please advise!

anu_t05-21 03:42 PMCheck with your attorney , But I 'm quiet sure that to to port the date your first 140 need to be approved. Since it is denied (although it is lawyer's mistake) you are out of luck.

amitjoey02-05 06:03 PMYou need approved EAD. apart from waiting for 180 days. You also need I-140 APPROVED. If you have just recently applied for EAD (2 weeks ago) Do not expect it till atleast early April. It is taking them more than 90 days to approve EAD.
WAIT till you get EAD Approved AND I-140 Approved. Research about AC21 and how you can take advantage of that. Read up threads on AC21. It is going to be a longer wait than you thought.

His I-485 adjustment was filed in August 2007 when visas opened up for 30 days, and since that time retrogressed. The applicant is from India and like many others in his shoes is eager for answers. So how do visa numbers become available?

In order to approve an application for adjustment of status (I-485), there must be a visa number available in the particular category. This, in turn, depends upon the country of chargeability and the priority date of the case. Once the U.S. Citizenship and Immigration Services (USCIS) has reviewed a particular I-485 application, a request is submitted to the DOS for a visa authorization. If the USCIS makes the request for a visa number to the DOS when the priority date of a particular case is current, and an immigrant visa number is available, the authorization is transmitted and the USCIS can approve the I-485 application. This is all tracked through the DOS Immigrant Visa Allocation Management System (IVAMS).

If an immigrant visa number for a particular individual is requested from the DOS by the USCIS, but none is available, the request is moved to the "pending" file with the DOS. Data from this pending file is used by the DOS to calculate the appropriate cutoff dates for the backlogged categories in the Visa Bulletin each month.

Cases placed in the pending demand category are processed as immigrant visa numbers become available. The DOS communicates with the USCIS regarding the A numbers of the cases for which visa numbers have been authorized. These cases are then processed to completion and green cards are then issued by the USCIS.

As you can see, this is a very complicated and streamlined process, with actual visa numbers tracked, issued, and assigned to particular green card cases as part of the approval process. Clients often do not understand why they have to wait, sometimes years for visa numbers to open, even after USCIS approvals. We hope that both agencies will find a better way to talk to each other and make the Immigrant visa process and much smoother one.
